COMMERCIAL ENERGY PERFORMANCE CERTIFICATES
An Energy Performance Certificate (EPC) must now be provided by Law whenever a commercial building of more than 50 sqm is constructed, modified, sold or let.
This new regulation is part of the Energy Performance of Buildings Directive which requires all EU countries to establish minimum energy performance standards for buildings.
An EPC is intended to inform potential buyers or tenants about the energy performance of a building, so they can consider energy efficiency as part of their investment or business decision to buy or occupy a building.
The vendor is responsible for providing the EPC before the building can be marketed for sale or let. Trading Standards Officers enforce this, and have the powers to fine a vendor for non-compliance. The fine imposed by trading standards for non compliance is fixed at 12.5 % of the rateable value up to a maximum fine of £5,000.
